Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Jersey Shore TRT is committed to protecting the privacy and security of your health information.

This Notice of Privacy Practices (“Notice”) describes how Jersey Shore TRT may use and disclose your protected health information (“PHI”), your rights regarding that information, and our legal responsibilities concerning your health information.

Protected health information generally includes individually identifiable information about your past, present, or future physical or mental health, healthcare services you receive, or payment for your healthcare.

Your Rights

You have certain rights regarding your health information. This section explains those rights and how you may exercise them.

Get a Copy of Your Medical Record

You may request to inspect or obtain an electronic or paper copy of your medical record and other health information we maintain about you.

We generally will provide access or a copy within the time required by applicable law. We may charge a reasonable, cost-based fee when permitted by law.

In certain limited circumstances, we may deny access to some information. If access is denied, you may have the right to request a review of that decision.

Ask Us to Correct Your Medical Record

If you believe health information we maintain about you is incorrect or incomplete, you may ask us to amend or correct it.

We may deny your request in certain circumstances permitted by law. If we deny your request, we will explain the reason in writing and inform you of any additional rights you may have.

Request Confidential Communications

You may ask us to communicate with you about your health information in a particular way or at a particular location.

For example, you may request that we contact you only at a specific telephone number, email address, mailing address, or through another available communication method.

We will accommodate reasonable requests as required by law.

Ask Us to Limit What We Use or Share

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.

We are generally not required to agree to these requests.

However, if you pay for a healthcare service or item entirely out of pocket and ask us not to disclose information about that service or item to your health plan for payment or healthcare operations purposes, we will honor that request when required by law unless disclosure is otherwise required by law.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures of your health information made during the period permitted by law before the date of your request.

The accounting will identify certain disclosures of your PHI and, where required, to whom the information was disclosed and why.

The accounting does not include every type of disclosure. For example, certain disclosures for treatment, payment, and healthcare operations generally are not included.

We will provide one accounting during a 12-month period without charge. We may charge a reasonable, cost-based fee for additional requests during the same period when permitted by law.

Get a Copy of This Notice

You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.

A current copy is also available on our website.

Choose Someone to Act for You

If you have given someone medical power of attorney or another person has legal authority to act on your behalf, that individual may exercise your privacy rights and make certain choices regarding your health information.

We may verify that the individual has appropriate legal authority before taking action.

File a Complaint

If you believe your privacy rights have been violated, you may file a complaint directly with Jersey Shore TRT using the contact information at the end of this Notice.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights.

Jersey Shore TRT will not retaliate against you for filing a privacy complaint or exercising your privacy rights.

Your Choices

For certain health information, you may tell us your preferences regarding what information we share.

Family, Friends, and Others Involved in Your Care

You may tell us whether you want us to share relevant health information with family members, close friends, caregivers, or other individuals involved in your care or payment for your care.

When you are unable to tell us your preference, such as when you are unconscious or otherwise incapacitated, we may disclose relevant information if we determine that doing so is in your best interest and is permitted by law.

We may also disclose information when necessary to lessen a serious and imminent threat to health or safety when permitted by law.

Disaster Relief

We may disclose relevant information to organizations assisting with disaster relief efforts so that family members or others responsible for your care may be notified of your location, condition, or status when permitted by law.

Marketing

Most uses and disclosures of your PHI for marketing purposes that require authorization under HIPAA will be made only with your written authorization.

Sale of Protected Health Information

Jersey Shore TRT does not sell your protected health information.

Any disclosure that would constitute a sale of PHI under HIPAA and require authorization would not occur without your written authorization.

How We May Use and Disclose Your Health Information

HIPAA permits us to use or disclose your health information for certain purposes without obtaining separate written authorization from you.

The following are common examples.

Treatment

We may use and disclose your health information to provide, coordinate, or manage your healthcare.

For example, we may share relevant medical information with another healthcare provider, laboratory, pharmacy, specialist, or other healthcare professional involved in your treatment.

Payment

We may use and disclose health information as necessary to bill for healthcare services and obtain payment.

For example, information may be used to process payments or determine coverage or benefits when applicable.

Healthcare Operations

We may use and disclose health information to operate our healthcare practice and improve the quality of care we provide.

For example, we may use health information for quality assessment, staff training, compliance activities, auditing, credentialing, healthcare administration, business planning, and evaluating our services.

Business Associates

We may disclose PHI to third-party service providers known as “business associates” that perform services for us involving PHI.

Examples may include certain electronic health record providers, practice management systems, technology providers, billing services, communication platforms, consultants, and other vendors.

When required by HIPAA, these organizations must enter into agreements requiring them to appropriately safeguard PHI and use or disclose it only as permitted by law and their agreements with us.

Electronic Communications and Telehealth

We may use electronic systems to provide healthcare services and communicate with patients, including electronic health records, patient portals, telehealth platforms, secure messaging systems, and other healthcare technologies.

We use reasonable safeguards designed to protect PHI transmitted or maintained electronically.

If you request or consent to communication through methods such as ordinary email or text messaging, you should understand that certain electronic communication methods may have inherent privacy and security limitations.

Other Uses and Disclosures Permitted or Required by Law

We may also use or disclose your health information without your written authorization in circumstances permitted or required by law.

These circumstances may include:

Public Health and Safety

We may disclose health information for certain public health activities, including:

  • Preventing or controlling disease

  • Reporting adverse reactions to medications or products

  • Reporting suspected abuse, neglect, or domestic violence when authorized or required by law

  • Preventing or reducing a serious threat to health or safety

  • Other legally authorized public health activities

Health Oversight Activities

We may disclose health information to authorized government agencies for legally permitted health oversight activities, including audits, investigations, inspections, licensing activities, and regulatory proceedings.

Required by Law

We may disclose health information when federal, state, or local law requires us to do so.

Judicial and Administrative Proceedings

We may disclose health information in response to certain court or administrative orders, subpoenas, discovery requests, or other lawful processes when the requirements of applicable privacy laws have been satisfied.

Law Enforcement

We may disclose health information to law enforcement officials in circumstances specifically permitted or required by law.

Coroners, Medical Examiners, and Funeral Directors

We may disclose health information to coroners, medical examiners, or funeral directors when permitted or required by law.

Workers' Compensation

We may disclose health information as authorized or required by laws relating to workers' compensation or similar programs.

Government Functions

We may disclose health information for certain specialized government functions when authorized by law, including certain military, national security, protective services, or correctional activities.

Uses and Disclosures Requiring Your Written Authorization

For uses and disclosures not otherwise permitted or required by law, we will obtain your written authorization.

This includes uses and disclosures requiring authorization under HIPAA, such as certain marketing activities and the sale of PHI.

If you provide written authorization, you generally may revoke that authorization in writing at any time. Your revocation will not affect actions we already took in reliance on your authorization before receiving the revocation.

Certain uses and disclosures of psychotherapy notes, if maintained by Jersey Shore TRT, require authorization except where otherwise permitted by law.

Substance Use Disorder Records

Certain records relating to substance use disorder treatment may receive additional protections under federal law, including 42 CFR Part 2, when those laws apply.

When we receive or maintain records protected by Part 2, we will use and disclose those records in accordance with applicable federal requirements.

Information disclosed pursuant to applicable Part 2 requirements may be subject to additional restrictions and protections regarding redisclosure and use in legal proceedings.

Additional Protections Under State and Federal Law

Certain categories of health information may receive protections beyond those generally provided by HIPAA.

When another applicable federal or New Jersey law provides greater privacy protection or imposes additional restrictions on the use or disclosure of particular health information, Jersey Shore TRT will comply with those requirements.

Our Responsibilities

Jersey Shore TRT is required by law to maintain the privacy and security of your protected health information.

We are also required to:

  • Provide you with this Notice describing our legal duties and privacy practices

  • Follow the privacy practices described in the Notice currently in effect

  • Use appropriate safeguards to protect your PHI

  • Notify affected individuals following a breach of unsecured PHI when notification is required by law

  • Respect your privacy rights under applicable law

We will not use or disclose your health information other than as described in this Notice unless you authorize us to do so in writing or another use or disclosure is permitted or required by law.

If you authorize us to use or disclose your information, you may revoke that authorization in writing as permitted by law.

Changes to This Notice

We reserve the right to change the terms of this Notice and our privacy practices.

Any revised Notice may apply to health information we already maintain as well as information we receive in the future.

If we make a material change, an updated Notice will be made available in our office and on our website as required by law.

You may request a current copy of this Notice at any time.

You will not be penalized or retaliated against for filing a complaint with Jersey Shore TRT or the U.S. Department of Health and Human Services.
